Terms of Service

These Terms of Service ("Terms") are an agreement between you and Gemify, operated by Rammaru Ito as an individual operator based in Japan. By using Gemify, you agree to these Terms. Please read them.

1. Acceptance of terms

By installing the Gemify Chrome extension, creating an account, or using the Gemify iOS app (when available), you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use Gemify.

2. What Gemify is

Gemify is a productivity tool that lets you block distracting sites (for example, social networks and video sites) and earn an in-app currency ("Gems") by completing Focus Timer sessions. Gems can be spent to temporarily unlock the sites you have blocked. Gemify is a self-help tool — it is not therapy, medical advice, or a clinical product.

3. Your account

Gemify requires you to sign in with a Google account, which we authenticate through Firebase. You are responsible for keeping your Google account secure and for activity that happens under your Gemify account. You must be at least 13 years old to use Gemify.

If you are under 18 (or under the age of majority in your jurisdiction), you may use Gemify only with the consent of a parent or legal guardian. Subscribing to Gemify Pro, which involves a recurring payment, specifically requires that consent.

4. Pro subscription and billing

Plans

Gemify offers a free tier and a paid "Pro" tier with monthly and annual billing options. Current prices are shown in the extension and on the checkout page before you confirm.

Free trial

Pro plans include a 7-day free trial. You must provide a valid payment method at signup. If you do not cancel before the trial ends, your selected plan will begin and you will be charged.

Auto-renewal

Subscriptions automatically renew at the end of each billing period (monthly or annual) until cancelled. You authorize us, through Stripe, to charge your payment method for each renewal.

Cancellation

You can cancel your subscription at any time from the Stripe Customer Portal, which is linked from the extension's settings page. Cancellation takes effect at the end of the current billing period; you keep Pro access until then.

Refunds

Charges are generally non-refundable, except where a refund is required by applicable law. If you believe you were charged in error, contact us at rammaru.ito@gmail.com.

Price changes

We may change prices for future billing periods. If we do, we will give you reasonable notice before the change takes effect. If you do not agree, you can cancel before the new price applies.

5. Acceptable use

When using Gemify, please do not:

  • Attempt to reverse engineer, decompile, or tamper with the service except as allowed by law.
  • Access the service through automated means (scrapers, bots) in a way that overloads or disrupts it.
  • Use Gemify to violate the rights of others or any applicable law.
  • Try to bypass payment, manipulate your Gem balance, or interfere with other users.

We may suspend or terminate accounts that violate these rules.

6. Intellectual property

Gemify, including its name, logo, design, and software, is owned by Rammaru Ito and is protected by intellectual property laws. These Terms do not grant you any right to use the Gemify name, logo, or branding outside of normal use of the product. You retain ownership of any content you create using Gemify.

7. Third-party services

Gemify relies on third-party providers, including Google (Firebase) and Stripe. Your use of those providers is also governed by their own terms and privacy policies. We are not responsible for outages, data loss, or other issues caused by third-party providers, but we will work in good faith to restore service.

8. Disclaimer of warranties

Gemify is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, whether express or implied, including but not limited to fitness for a particular purpose, merchantability, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that it will achieve any particular productivity outcome.

9. Limitation of liability

To the maximum extent permitted by law, Gemify and its operator will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or business interruption, arising from your use of or inability to use the service. Our total liability for any claim relating to the service will not exceed the amount you paid us in the 12 months before the event giving rise to the claim, or, if you are on a free plan, USD 50.

Nothing in these Terms limits liability that cannot be limited under applicable law (for example, liability for gross negligence or willful misconduct under Japanese law).

10. Termination

You can stop using Gemify at any time by uninstalling the extension and, if you want, requesting account deletion at rammaru.ito@gmail.com. We may suspend or terminate your access if you violate these Terms or if we discontinue the service. If we discontinue Pro, we will refund any unused, pre-paid portion of your subscription.

11. Changes to these terms

We may update these Terms over time. If we make material changes, we will update the "Last updated" date above and, where appropriate, notify you in the app or by email. Continued use of Gemify after the changes take effect means you accept the updated Terms.

12. Governing law and jurisdiction

These Terms are governed by the laws of Japan, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the service will be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.
